Regulatory Compliance, Permitting and Expert Testimony

APT Team members have assisted clients with local, state and federal environmental permitting compliance requirements, providing them with the expertise to make informed decisions on how projects should proceed and helping navigate through the regulatory approval and permitting processes. Perhaps of equal importance, APT assists clients in promoting avoidance of state/federal permit triggers. Specific areas of permitting expertise include:

  • National Environmental Policy Act
  • U.S. Army Corps of Engineers Permitting
  • Clean Water Act (Sections 10, 401 and 404)
  • National Historic Preservation Act (in particular Section 106)
  • Endangered Species Act
  • Federal Energy Regulatory Commission
  • Connecticut Siting Council
  • Connecticut Inland Wetlands and Watercourses Act
  • Connecticut Tidal Wetlands Act and Coastal Zone Management Act
  • Local Bylaw Regulations

APT’s Siting and Permitting Team has specific expertise in assisting its telecommunications clients with fulfilling National Environmental Policy Act (NEPA) requirements. Team members have evaluated over 1,000 site locations for compliance with NEPA, including preparation of Environmental Assessments and negotiating Memorandums of Agreements with review agencies.

Members of the APT Team also have extensive experience with the Connecticut Siting Council (the “Council”) having been collectively involved in over 200 Dockets and Petitions. We offer our Clients proven and credible environmental and engineering consultants that can provide valuable support and regulatory insight on their projects. We have assisted several telecommunications and utility industry clients with the development of support documents to the Council, including Location Approval submissions, Municipal Consultation Filings, Applications for Certificates of Environmental Compatibility and Public Need, Petitions for Declaratory Ruling, and Development and Management Plans, as well as providing expert witness testimony.
